The Italian Data Protection Authority issues a new measure to regulate profiling cookies.

In the past days, the issue from the Italian Data Protection Authority has come effective: it forbids websites publishers the use of profiling or marketing cookies in absence of clear information and users’ approval.

In other words, any user will autonomously decide if giving approval to usage of information on websites visited to receive targeted advertising. How? From now on, accessing the home page or any other page of a website, users will see a banner stating that the website is collecting profiling cookies to send targeted advertising, including third parties cookies (installed from a different supplier than the website publisher).

The banner will also provide a link to the complete information including the possibility to deny consent to website’s or third parties’ cookies. This information page should also be linked from any website’s page.

The same banner will also warn users that, keeping on the navigation of the website, they will give automatically permission to cookies usage.

Regarding the obligation for website publisher to maintain user’s consent, it will be possible to install a technical cookie that will avoid the publication of the short information.

The Italian Data Protection Authority states that all the websites will have to conform to the new issue within one year from the becoming.
